Shasta DA condemns local vigilante actions following arrests

REDDING, Calif. — The Shasta County District Attorney's Office filed charges against members of a local vigilante group after their arrests following a "To Catch a Predator"-style operation.

Three members of the vigilante group calling itself Redding Dads Against Predators (DAP) have been arrested because of what they allegedly did during one of their catches of alleged pedophiles.

The group formed in August as essentially a local grassroots version of 'To Catch a Predator'. Their escalating tactics have caught the eyes of many online, and thousands of followers. However, now police say it has led to both their arrests along with the arrest of the alleged predator they were trying to catch.

The DAP members arrested were David Joseph Zimmerman, Kasey Lane O'Donnell and Syrus Deville Durant. All three are facing multiple charges, including felony assault, false imprisonment, conspiracy to commit a crime, battery and vandalism.

The Shasta County District Attorney's Office issued a statement regarding the vigilante group, announcing that charges have been filed against three of its members; condemning their actions:

"The Shasta County District Attorney’s Office filed charges against three members of a local Dads Against Predators (DAP) group, Kasey O’Donnell, Syrus Durant and David Zimmerman. The charges filed include conspiracy, false imprisonment by violence, battery, and vandalism.

These charges stem from an incident where three members of a local DAP group met with a person at Caldwell Park after O’Donnell communicated with the person. The person the three defendants met with is a person who has a mental disability. The defendants chose to prevent the person from leaving the location by taking his bicycle, yelling at him, damaging his bike, and physically assaulting him, resulting in him going to the hospital.

Vigilante justice has no place in our community. The actions taken by this particular DAP group to find “predators” is being done in a way which violates investigative techniques used by trained law enforcement and trained civilians to properly investigate and preserve evidence for successful prosecution. The actions of this particular DAP group are allowing individuals who they believe have a sexual interest in minors, to get away with an actual slap on the face rather than being prosecuted. The humiliation tactics used by this particular DAP group will not serve as a long-term deterrent, and it interferes with the proper investigation and successful prosecution of potential offenders.

DO NOT take action into your own hands. The District Attorney’s Office asks that the community provide tips and leads on potential crimes, including all information the community may have regarding child physical and sexual abuse or human trafficking, to Law Enforcement." ...

The police report states in the following days DAP members claimed *** was the aggressor. However, a video police say they obtained from O'Donnell's phone showed that *** tried to leave the scene multiple times, and not make a violent move until he was pushed and hit repeatedly by the DAP team. The video goes on to show that as *** began to fight back he was tackled from the back and hit in the head repeatedly with punches and kicks. Going on for several minutes until nearby security guards broke up the altercation.

Who is Donna Zink and why does she want info on Washington's Level 1 registrants?

This is Donna Zink of Mesa, WA. She has been in the news recently for filing public records requests to obtain info on the state's Tier 1 registrants, which are not available online, and for good reason-- Washington has been a hotbead of vigilante activity, from the double homicides of 2005 to the Angry Tammy Gibson case, to the more recent Patrick Drum vigilante killings last summer.

This poss the question-- just who is Donna Zink? She's a former mayor and councilwoman of Mesa, a small "blink and you miss it" town is SE Washington state. That was a long time ago, so these days, she makes her living by abusing public records requests. She won a quarter-million-dollar lawsuit against the city for a public records request flub, so now, she is looking to make a quick buck elsewhere.

So now, she's found a way to make news again. Since Washington's Level 1 registrants are not available online, Donna Zink is looking to change that. Despite her claims to the contrary, she is abusing registry info.

Personally, I see nothing in the law that saws she is entitled to the Level 1 registry info. She cites RCW 4.24.550 as her justification, but the law says this about the release of Level 1 info:

 (3) Except for the information specifically required under subsection (5) of this section, local law enforcement agencies shall consider the following guidelines in determining the extent of a public disclosure made under this section: (a) For offenders classified as risk level I, the agency shall share information with other appropriate law enforcement agencies and, if the offender is a student, the public or private school regulated under Title 28A RCW or chapter 72.40 RCW which the offender is attending, or planning to attend. The agency may disclose, upon request, relevant, necessary, and accurate information to any victim or witness to the offense and to any individual community member who lives near the residence where the offender resides, expects to reside, or is regularly found;

  (5)(a) When funded by federal grants or other sources, the Washington association of sheriffs and police chiefs shall create and maintain a statewide registered kidnapping and sex offender web site, which shall be available to the public. The web site shall post all level III and level II registered sex offenders, level I registered sex offenders during the time they are out of compliance with registration requirements under RCW 9A.44.130, and all registered kidnapping offenders in the state of Washington.

Sounds like she's not entitled to the info, if you ask me, unless she lives all over Benton AND Franklin counties. She has publicly shown her battle HERE and HERE as well. She does admit that the registry is intended to punish, plus she illustrates the level of ignorance typical of someone with a television style education:

Since Patrick Drum avoided the death penalty to the cheers of his fanatical followers, and in light of other stories of people getting away with murder by claiming sexual abuse, it is no surprise that people are using the abuse excuse to cover other crimes like murder/ robbery. I guess we can expect people to send money to these people's commissary fund now? And we all know how vigilantes are such fine, outstanding citizens. While I'm on the subject, why is it every vigilante story from Washington state involves drug abusers? First Angry Tammy Gibson, then Patrick Drum, now these wackos.

People arrested in death of Lakewood man claim they attacked him to avenge sex crimes

Pierce County prosecutors today charged a 30-year-old man with first-degree murder, first-degree robbery and first-degree kidnapping in the death of a Lakewood resident whose body was dumped in Graham last month.

Jeffrey Wayne Powell II was being sought on a nationwide arrest  warrant at press time.

Prosecutors contend Powell and at least four other people were involved in the abduction, robbery, beating and strangulation of Dean Barker, 51, whose body was found outside a new home for sale in the 22200 block of 124^thAvenue East on Sept. 8.

Three of those people – William Barrry, 34; Angela King, 24; and Justin Mahaffey, 23 – made a preliminary appearance in Superior Court on this afternoon and were ordered jailed in lieu of $2 million bail apiece. The fourth person, Aileenah Horton, 17, appeared in court Friday and also was ordered held in lieu of $2 million bail.

Prosecutors expect to formally charge them all Tuesday, and deputy prosecutor Phil Sorenson said more arrests could be made in the case.

What prompted Barker’s killing remained in question this afternoon.

Horton and King told authorities Barker had sexually assaulted them in the weeks before his death, court records state. The group also believed Barker had molested Barry’s 3-year-old daughter the day he was abducted, Horton told authorities.

The group decided to kidnap and attack him to avenge those alleged sex crimes, both Horton and King told detectives.

Pierce County Prosecutor Mark Lindquist said today there is no evidence  Barker sexually assaulted the 3-year-old. Lindquist also said there is no evidence corroborating the claims by Horton and King that Barker sexually assaulted King.

“It’s not clear if this is a case of vigilante revenge or if the allegation of sexual assault is just a cover story.” said Lindquist, who pointed out all the defendants and the victim have lengthy criminal records. “In either case, we have a kidnapping and brutal murder.”

The evidence shows that Barker was robbed of his watch and his wallet and that someone tied a red bandana around part of his body, possibly indicating he was killed by someone with affiliations to a local street gang that favors the color red, Lindquist said.

Mahaffey might have ties to that gang, Lindquist added.

Those are words from a district attorney as members of vigilante groups orgasm over the slayings of two people forced to register on the public pillory. Vigilante groups like Evil-Unveiled, Mothers Against Pedophiles, and No Peace For Predators are already planning to send this dangerous killer money for his defense, but at least this dangerous homicidal maniac will be off the streets so he cannot kill again. This man claimed to have a "particular animus toward sex offenders." He was denied bail and charged with aggravated murder. I am against the death penalty but he will be eligible for the death penalty.
